This Additional Property Billing Policy explains how additional-property charges are calculated for Fructus subscription plans that include a property allowance and additional-property pricing.
It forms part of the Fructus Customer Terms of Service where additional-property charging applies.
In this policy, “Fructus”, “we”, “us” and “our” mean Fructus Technologies Ltd.
1. Professional property allowance
The Fructus Professional plan includes up to 30 billable properties within its base subscription.
Where an organisation has more than 30 billable properties, an additional charge of £4 per additional property per month applies, subject to the caps described in this policy.
Additional-property billing applies separately to each Fructus organisation and is based on the billable properties held within that organisation.
2. Monthly Professional subscriptions
The standard Professional monthly subscription is £79 per month, including up to 30 billable properties.
Properties 31 to 60 are charged at £4 per additional property per month.
The total standard Professional monthly subscription charge is capped at £199 per month for organisations with between 60 and 100 billable properties.
This means:
- 30 properties: £79 per month;
- 31 properties: £83 per month;
- 35 properties: £99 per month;
- 40 properties: £119 per month;
- 50 properties: £159 per month; and
- 60 to 100 properties: £199 per month.
Properties above 60 do not increase the standard Professional monthly charge beyond the £199 monthly cap while the organisation remains eligible for the Professional plan.
3. Annual Professional subscriptions
The standard Professional annual subscription is £790 per year, including up to 30 billable properties.
The £790 annual charge covers the Professional base subscription only.
Where an organisation has more than 30 billable properties, additional properties are charged separately at £4 per additional property per month.
A maximum of 30 additional properties are charged, so the maximum additional-property charge is £120 per month.
The annual discount applying to the Professional base subscription does not apply to additional-property charges.
For example:
- 30 properties: £790 annual base subscription with no additional-property charge;
- 35 properties: £790 annual base subscription plus £20 per month;
- 40 properties: £790 annual base subscription plus £40 per month;
- 50 properties: £790 annual base subscription plus £80 per month; and
- 60 to 100 properties: £790 annual base subscription plus a maximum of £120 per month.
Additional-property charges may therefore continue to be billed monthly during an annual Professional subscription.
4. What counts as a billable property
Each property recorded within a Fructus organisation counts as one billable property unless it has ceased to count in accordance with this policy.
A property's billable status is not affected solely because the property:
- is vacant;
- has no current tenant or occupier;
- contains no units;
- is undergoing maintenance or refurbishment;
- is being marketed for sale;
- has an offer accepted;
- is under offer or subject to contract; or
- is otherwise temporarily not generating rent or income.
The number of units, tenants, occupiers or contacts associated with a property does not cause that property to count as more than one property for the purposes of this policy.
5. Sold and disposed properties
A property ceases to count as a billable property when its sale or disposal has been recorded in Fructus as sold and completed, with a completion date of that day or earlier.
Listing a property for sale does not stop it counting.
Marking a sale as under offer, agreed or subject to contract does not stop it counting.
This reflects the fact that the property remains part of the portfolio being managed through Fructus until its disposal completes.
If a completed disposal is subsequently corrected or reversed so that the property again qualifies as a billable property, it may be included in the organisation's property count again.
6. When additional-property charges change
Additional-property charges operate on a monthly billing cycle.
Changes to the number of billable properties during an existing additional-property billing period do not result in daily or mid-period proration.
Instead, the updated billable-property count is used to determine the applicable additional-property quantity for the next additional-property billing period.
For example, if an organisation increases from 30 to 31 billable properties during a billing period, the additional property does not generate a separate part-month charge simply because it was added during that period. The updated additional-property quantity applies from the next applicable additional-property billing period.
The same principle applies when the number of billable properties decreases.
A property that ceases to count part-way through an additional-property billing period does not normally generate a part-period refund or credit. The reduced property count is reflected in the applicable additional-property quantity for the next billing period.
7. Multiple changes during a billing period
An organisation's billable-property count may increase or decrease more than once during a billing period.
Fructus may recalculate the required additional-property quantity as the organisation's property count changes.
The amount applicable to the next additional-property billing period is based on the billable-property count applicable to that period, subject to the Professional plan allowance and caps.
This means that temporary changes within a billing period do not create a series of separate daily property charges or credits.
8. Additional-property quantity
For the standard Professional plan:
- the first 30 billable properties are included;
- properties above 30 become additional properties;
- a maximum of 30 additional properties are chargeable under the standard Professional pricing structure.
Accordingly, the chargeable additional-property quantity is calculated as the number of billable properties above 30, capped at 30 additional properties.
For example:
- 29 properties = 0 additional properties;
- 30 properties = 0;
- 31 properties = 1;
- 35 properties = 5;
- 50 properties = 20;
- 60 properties = 30;
- 75 properties = 30; and
- 100 properties = 30.
9. Professional and Enterprise threshold
The standard Professional plan supports organisations managing up to 100 billable properties.
Where an organisation grows beyond 100 billable properties, Fructus may contact the Customer to review its requirements and discuss an appropriate Enterprise arrangement.
Reaching 101 properties does not automatically change the Customer's subscription price or cause Fructus to delete, remove or restrict access to existing property records.
While an Enterprise arrangement is being discussed, the standard Professional additional-property charge remains subject to its existing maximum charge unless and until a different arrangement is agreed with the Customer.
Fructus may require customers whose ongoing usage exceeds the Professional threshold to move to an appropriate Enterprise arrangement on reasonable notice.
Any Enterprise pricing, allowances or other commercial terms will be agreed separately and will not be imposed retrospectively on usage occurring before the applicable Enterprise arrangement takes effect.
10. Trial periods
No Professional base subscription charge or additional-property subscription charge is payable solely for use during an applicable free trial.
The organisation's property count may nevertheless be used to determine plan eligibility and the applicable subscription configuration.
Unless the trial is cancelled before it ends, the selected paid subscription begins in accordance with the Customer Terms of Service.
Additional-property charging then applies in accordance with this policy.
11. Upgrades to Professional
Where an organisation upgrades to Professional, the number of billable properties within the organisation may be used to determine the applicable additional-property quantity.
The financial effect and effective date of an upgrade may depend on whether the subscription is trialling or already paid and will be presented through the applicable subscription-change process where available.
Once Professional additional-property billing applies, subsequent property-count changes are treated in accordance with this policy.
12. Downgrades from Professional
A downgrade may be unavailable where the organisation's billable-property count exceeds the property allowance of the proposed lower plan.
Where a permitted downgrade takes effect, Professional additional-property charging will cease in accordance with the effective date of that subscription change.
Any amount properly due for a period before the downgrade takes effect remains payable.
13. Cancellation
Cancelling a Professional subscription prevents the applicable subscription from renewing after the end of its current trial or paid subscription period.
Cancellation does not retrospectively remove additional-property charges properly incurred before the subscription ends.
For an annual Professional subscription, additional-property charges may continue to be billed monthly while the annual subscription remains active, including after renewal has been cancelled but before the current annual subscription period ends.
Any outstanding amount properly due when the subscription ends remains payable.
14. Property records and billing avoidance
Customers must maintain property and disposal information accurately.
Property records, disposal information or other lifecycle information must not be deliberately created, changed, removed or misrepresented for the purpose of avoiding legitimate subscription charges.
Where we reasonably identify an obvious billing discrepancy caused by incorrect or manipulated property information, we may contact the Customer to resolve the discrepancy.
We will not retrospectively impose additional-property charges merely because a genuine property disposal or correction has been properly recorded.
15. Billing information
Where available, Fructus may display information including:
- the organisation's current billable-property count;
- the number of properties included within the plan;
- the calculated number of additional properties;
- the applicable additional-property rate; and
- the applicable maximum additional-property charge.
Property counts shown within the application may change before the next billing period and therefore may not always represent an amount already invoiced or collected.
Stripe or another payment provider may separately provide invoices, receipts and payment information.
16. Billing discrepancies
If you believe an additional-property charge or property count is incorrect, contact Fructus as soon as reasonably possible.
We may review the relevant property records, disposal information, subscription information and billing records to determine whether an adjustment is appropriate.
Where we identify an error in a charge, we will take reasonable steps to correct it.
17. Changes to this policy
We may update this policy from time to time, including where our subscription structure, billing systems or service changes.
The current version will be published through the Fructus Policies & Legal centre and will show its version and last-updated date.
Where a change materially affects the way an existing Customer is charged, we will provide reasonable notice before the change takes effect.
Changes to this policy will not retrospectively create additional charges for usage occurring before the relevant change took effect.
Where appropriate, we may require an authorised user to accept an updated version of this policy.
18. Relationship with the Customer Terms
This policy forms part of the Fructus Customer Terms of Service where additional-property charging applies.
If there is a conflict between this policy and the Customer Terms specifically concerning the calculation or timing of Professional additional-property charges, this policy will apply to that issue.
